The sites that Yola produces are encoded as, and written in HTML 4. Once HTML 5 reaches popular usage and predominant browsers support it properly, we will examine switching sites to HTML 5. All browsers in popular use support HTML 4, while there are selected browsers which support and implement the HTML 5 spec. Switching to a different DOCTYPE definition is not a choice which can be taken lightly, and would potentially affect a number of our users, and visitors to their sites.
So, no, we don't support HTML 5 yet, but when it is appropriate to move from 4 to 5 we will do it.
At this time you will need to use a menu that is not HTML5.
